price for less, and laugh all the best. ♪ city hall, you fix the rest. thank you. >> chair wiener: thank you. next speaker please. >> can't top that. my name is brian, i represent a six unit building in district 3 in russian hill. we're a big variety of owners who got school teacher, accountant, salesperson, freelance journalist and city employee. so i think we represent some cross-section of san francisco. we never evicted anybody in our building but at the same time one of our owners -- two of our owners had kids, they had to move out, they weren't able to sell their unit so they're stuck renting and losing money every month. it's hurting them and their ability to get started in their new lives. i think for a lot of us, myself included, it feels like a bit of a waste to paying an extra point and a half to our mortgage every month to the bank. we would much rather give it to the city than give it to the banks, in the form of this affordable housing fee at a time when the city can use it. and so i'm in support of the legislation and i hope you guys will consider it. thanks. >> chair wien

's the right thing to do. thank you. >> chair wiener: thank you very much. next speaker please. >> thank you very much. my name is nancy mcnally, and i'm a native san franciscan. i've been here 63 years. my daughter is a lawyer. she graduated bolt, she has an mba, she went to sarah lawrence. i'm a foster kid. it's kind of a miracle, what my daughter experienced by her hard work. and she was forced to move to oakland a few months ago, because she's been priced out. well, i wanted to give you a little historical information about what it's like to be an aids activist in 2013. what i noticed in '89, and i don't think any of you folks, sitting there, were here in '89 -- oh, you were. okay. i don't know how old you were, but my land lady was a small time realtor named greta from skyline. she owned quite a few properties. she decided what a great idea, i'm going to take advantage of the fact that no one is willing to rent to people with aids. i will. she kicked out people left and right, including me. and tripled the rents. they were happy to have her. no one else was willing. she took advantage.

wiener: thank you very much. next speaker. >> hello. my name is julie, and i'd like to thank the supervisors for taking this into such serious and strong consideration. i think what's evident today is that the t.i.c. units and ownership is very unique to san francisco and therefore requires unique and brave decisions. i'm a single woman, i've lived here for 20 years, i bought my first home as a t.i.c., not because i was looking to flip a unit, not because i'm wealthy but because i worked very hard to do what seemed practical and smart. i can't believe i'm standing here right now thinking that buying a home in san francisco is the most regrettable thing i've ever done because it's actually the most difficult, pretty much anywhere in the country. i think the devastating concern right now is of course what people have said about these loans. but san francisco is a subprime market crash waiting to happen. and we have to wake up and all of you, the supervisors opposed, have to consider the reality of this. the difference is that we are not subprime in that we've all honored these

i cannot wait until the next tech bust. i can't wait until we see the end of this. >> chair wiener: thank you. next speaker. >> [speaking foreign language] >> translator: good afternoon. my name is -- and i'm the president of community tenant association. we're the largest tenant based -- organization in the city and our 1,000 members are all low income mono lingual renters. we have 50 present and some are in the overflow room and we're here regarding our concerns on the proposed legislation. if t.i.c.s are allowed to buy back the condo conversion process these units will be taken out of rent control stock and will open the flood gate and incentivize the speculators. a lot of the tenants are low income and will not afford other places. i have also experienced ellis act eviction process and i do not wish this upon anyone to go through. also speculators will be motivated into the t.i.c. market. -- the waiting list, we're concerned more speculators will jump into the market and -- to get into the condo conversion while empty. this will not create new housing, let alone affordable. we

in the hall they told us -- >> chair wiener: if there's been any confusion just go ahead and speak. that's fine. >> my name is sarah, i moved back to san francisco 10 years ago to take care of my -- partially to take care of my father who had gone on disability and lives in a represent controlle -- rent cond apartment. people talk about home ownership. most of us would love to own a home in san francisco. we would be happy to stay here. in 1980, they were having a debate about condo conversion in san francisco, actually, at the supervisors hearing. and the debate then was if something became a condo, did 40% of the existing tenants have to be able to buy in, or did 80% of the existing tenants have to buy in. right now, none of the existing tenants have to buy in, for it to become a condo. it can go to a t.i.c. first and flip that process. we're not talking about tenants and buildings being able to buy their units. renters being able to buy their units. you're asking people who are a higher income group being able to kick out people, often with a middle man, a speculator, doing it. if fol

years. thank you. >> chair wiener: thank you. thank you. if i could just remind, we -- again, no audible applause, booing, hissing. if you want to raise your hand to express aroofl, that's -- approval, that's great. next speaker. >> my name is kenneth laverne, i live in district 8. i'm a renter. i live on social security. i'm disabled. i think supervisors are well aware that the real estate market is red hot again right now, and there are great pressures on renters to be removed from units. i think this is another tool in the toolbox of landlords and real estate interest, to remove us from our units. i've been in my unit since 1988. i could not live in san francisco without this -- without living in rent control, and living in this unit. if i moved, my rent would triple or quadruple. i don't believe there's any enforcement in -- i don't think that the lifetime leases, from what i've seen today, from dpw, and the city attorney, that there are any real enforcement mechanisms. regardless of whether this would conflict with state law, the costa hawkins law, or ellis law. from what i've seen

, not 8 million dollar condos. thank you. >> chair wiener: thank you. next speaker. >> good afternoon, supervisors. i'm sarah short with the housing rights committee of san francisco. we oppose this legislation strongly. good public policy, i think addresses a demonstrated need. we've heard a lot of an h anecds today and heard people tell stories as t.i.c. owners of needing larger space or wanting to refinance but how many t.i.c. owners are underwater, in default, facing foreclosures. we don't know the answers and need to do better due diligence and see if that really is a problem. i imagine if you went to the assessor's office you wouldn't find that many. it's not a crisis of the proportions that would be worth the trade-off, which is an incentive for more evictions in a city where our rents are already skyrocketing and we have a huge hoamsdz homeless problem. the other question i would ask is how many of these t.i.c.s after they convert to condos are then sold. we hear a lot of people up here saying i'm not a flipper, i'm not a real estate speculators. i believe them but those flipp

by this particular project. because of that there's no categorical exemption. >> supervisor wiener: do you think that if the masonic project didn't exist, would this project be categorically exempt? >> the answer is no, it would not. it would still not be categorically exempt because the two exemptions they rely on really don't apply. one is existing facilities, which is minor alteration of existing facilities involving negative liberal or no -- use. and one of the examples is cited of an existing facility can be a bicycle trail. well there is no bike lane existing on oak so the exemption doesn't even arguably apply to oak. there are no buffer strips on either street nor are there raised plantares. so it wouldn't apply to that piece of it. and i guess getting out to the idea of raised plantares this is also a unique circumstance which is one of the other item -- one of the other categories that takes you out of the exemption because -- this is the first time in any project in san francisco where you can actually have these raised concrete plantares in the middle of the street in effect which wil

the project sponsor. thank you, sir. supervisor wiener. >> when the project sponsor is done, i was unclear from dpw's response about whether the normal procedure for dpw would have resulted in the specified notice. that was a little unclear to me. >> sir. >> good afternoon, (inaudible) consulting. we started working on this project on july of 2008. we had two, two-unit buildings proposed on this site and we met with the east slope design review board, the design review board, we did a number of meetings with them, initially before they even filed the building permit. after we filed the building permit we made modifications to the design and filed with the planning commission and we were asking for a parking variance so we could keep the square footage of the building so it could accommodate the two, two-unit buildings. we were asked at that meeting to avoid doing a variance and reduce the size of the building. we have gone from 4 units to 2 units and now it's single families, we have lost over 1700 square feet, we have gone through a number of meetings with neighborhood and all that d
